Bio

Brandy A. Hood is Counsel in the Washington, D.C., office of Buckley LLP, where she advises bank and nonbank mortgage lenders, servicers, and insurers on compliance with federal and state regulatory requirements. Ms. Hood has extensive experience in the Truth in Lending Act-Real Estate Settlement Procedures Act Integrated Disclosure (TRID) rule and the Flood Disaster Protection Act (FDPA), and she speaks on these topics regularly. She also advises on the full range of federal consumer protection laws and regulations, including Section 8 of the Real Estate Settlement Procedures Act (RESPA), the Ability-to-Repay and Qualified Mortgage (ATR/QM) rule, the Loan Originator Compensation rule, and other issues under the Truth in Lending Act (TILA), the Equal Credit Opportunity Act (ECOA), Fair Debt Collection Practices Act (FDCPA), and Fair Credit Reporting Act (FCRA), and the prohibition on unfair, deceptive, or abusive acts or practices (UDAAP).



Her practice includes:




  • Advising on compliance with the TILA-RESPA integrated disclosure rule, including issues related to implementing the original rule and subsequent amendments, responding to examination requests, and developing new mortgage products

  • Advising on various issues relating to the mandatory purchase of flood insurance requirements and natural disaster response requirements, including developing flood insurance policies and procedures and responding to examination requests and threatened enforcement actions

  • Assisting lenders in the development of new lending products and online tools, including drafting agreements and disclosures for home equity lines of credit (HELOCs) and providing guidance on regulatory risks related to new online platforms used to facilitate application and prequalification requests

  • Assisting clients in obtaining informal guidance from federal and state regulators

  • Analyzing mortgage origination document packages to ensure compliance with federal and state law

  • Assisting clients in preparing for changes in regulations, developing compliance protocols, and responding to regulatory examinations, investigations, and enforcement actions

  • Preparing comprehensive surveys of federal and state laws and regulations on various mortgage lending and servicing topics

  • Evaluating operations for regulatory compliance, including reviewing mortgage servicing operations in preparation for a Consumer Financial Protection Bureau (CFPB) examination and evaluating default servicing operations for compliance with servicing standards and regulations
